Irfan Arif, Managing Director and Barrister at Chess Law Solicitors, is instructed as counsel by an external firm of solicitors to represent a medical professional facing an allegation arising from the alleged transmission of a sexually transmitted infection.
The client was originally charged with causing grievous bodily harm with intent, contrary to section 18 of the Offences Against the Person Act 1861.
At the Plea and Trial Preparation Hearing, Irfan challenged the basis upon which the section 18 allegation was being pursued. Following discussions with the prosecution, the section 18 charge was withdrawn, substantially narrowing the case to the lesser allegation under section 20.
The client maintains his defence and Irfan is now preparing the case for trial, listed for late 2027.
The case involves complex issues of medical evidence, knowledge, causation and criminal liability, requiring careful analysis of both the scientific evidence and the circumstances surrounding the allegation.
