What Happens After Arrest in the UK?

Being arrested is one of the most serious experiences a person can face. It often happens quickly, without warning, and can be difficult to process. Understanding what happens next is essential in protecting your position.

An arrest must be based on reasonable suspicion that you have committed an offence, and the officer must inform you of the grounds for arrest. Once arrested, you will be taken to a police station where you will be booked into custody.

At the police station, your rights are explained. You have the right to free legal advice, the right to remain silent, and the right to have someone informed of your arrest. These rights are fundamental and should always be exercised.

You may then be interviewed under caution. This is a formal process and is often the most important stage of the investigation. What you say during interview can be used in evidence. It is essential that you do not answer questions without legal advice.

Following the interview, the police must decide how to proceed. You may be released without charge, released under investigation, bailed with conditions, or charged. The outcome often depends on the evidence and the approach taken during the interview.

There are also strict time limits on detention. In most cases, the police can detain you for up to 24 hours without charge, although this can be extended in more serious cases.

If you have been arrested, immediate legal advice is critical. You should review our 24 Hour Police Station Solicitors page and seek assistance without delay.
